Terms of Service

These Terms constitute a legally binding agreement between you and FuseTek Labs, Inc. (“Nexfuse,” “we,” “our,” or “us”). By accessing or using the Nexfuse mobile application, website, or any related services (collectively, the “Services”), you agree to these Terms and our Privacy Policy.

You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or guardian’s permission to use the Services.

Nexfuse is a social platform that combines financial market data, sports picks, and community features. The Services allow you to:

• Track cryptocurrency and stock prices and build a personal watchlist
• Make picks on sports games using publicly available odds
• Build and share parlay picks with other users
• Participate in a social feed, follow other users, and view leaderboards
• Receive notifications for market movements, pick results, and social interactions

Picks made on Nexfuse are simulated — no real money is wagered through the platform. Nexfuse is not a gambling platform, sportsbook, or licensed financial advisor. We do not facilitate, process, or hold funds on your behalf.

Past pick performance does not guarantee future results. Always consult a qualified financial professional before making investment decisions, and gamble responsibly through licensed operators in your jurisdiction.

Registration. To access most features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Accuracy. You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.

One Account. You may not create multiple accounts to circumvent bans, restrictions, or leaderboard rules. Creating duplicate accounts is grounds for suspension.

Account Security. Notify us immediately at info@fuseteklabs.com if you believe your account has been compromised.

Your Content. You retain ownership of content you post to Nexfuse (posts, comments, picks, and profile information). By posting content, you grant Nexfuse a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content within the Services.

Content Standards. You agree not to post content that:

• Is unlawful, harmful, threatening, abusive, harassing, or defamatory
• Impersonates another person or entity
• Contains spam, unsolicited advertising, or phishing links
• Violates the intellectual property rights of others
• Contains explicit sexual content or graphic violence
• Promotes illegal activity

Reporting. You may report content that violates these standards using the in-app report feature. We reserve the right to remove content that violates these Terms at our sole discretion.

Nexfuse is a community platform. You agree to treat other users with respect. The following are prohibited:

• Harassment, bullying, or targeted abuse of other users
• Coordinated manipulation of leaderboards or picks
• Using automated bots or scripts to interact with the Services
• Scraping or reverse-engineering the platform
• Any attempt to interfere with the operation of the Services

Nexfuse offers optional paid features (“Premium”) that provide access to additional data, analytics, and tools. Premium features and pricing are described in the app at the time of purchase.

All purchases are subject to the payment terms of the platform through which you subscribed (Apple App Store or Google Play). Refunds are governed by the respective platform’s refund policies. We do not process refunds directly.

The Services display market data, sports odds, and scores sourced from third-party providers. This data is provided for informational purposes only and may contain errors or delays. Nexfuse is not responsible for the accuracy, completeness, or timeliness of third-party data.

The Services may contain links to third-party websites. We are not responsible for the content or practices of those sites.

The Nexfuse name, logo, app design, and original content are owned by FuseTek Labs, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written permission.

By You. You may stop using the Services at any time. To delete your account and associated data, contact us at info@fuseteklabs.com.

By Nexfuse. We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Services immediately ceases.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEXFUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

NEXFUSE’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NEXFUSE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

You agree to indemnify and hold harmless FuseTek Labs, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page and, where required, by sending a notification through the app or via email. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
